Road Accident fund High Court Matter
Madiba & Co. Attorneys acted for the Road Accident Fund in a significant High Court matter concerning the lawfulness of attachment and execution against assets not owned by the judgment debtor, but leased from third-party suppliers. The case raised important questions about public power, the rule of law, property rights, and the limits of the Sheriff’s authority when executing writs against a state entity.
The matter reinforced critical safeguards in the execution process, protecting:
